Occupancy Permits (AB 3205)

Introduction

California Government Code Section 65850.2(c) mandates that no city or county agency shall issue a building permit or certificate of occupancy unless the local air pollution control district requirements are met. City and county building officials should direct business applicants to contact VCAPCD for air pollution control clearance prior to issuance of building occupancy permits.

Occupancy Permit Review Questionnaire (AB 3205)

The district developed the following questionnaire to help building officials and applicants for occupancy permits comply with the legislation.

The main purpose of the questionnaire is to screen new or modified businesses that may need a VCAPCD permit. It lists operations and equipment that typically require permits from the district. For more information on the district's permitting program, visit the overview webpage.

The questionnaire also helps determine whether businesses need to submit a separate notification to the district regarding demolition or renovation projects that involve asbestos removal or comply with Rule 211, VCAPCD's Transportation Outreach Program.

The completed Occupancy Permit Review Questionnaire can be emailed to notifications@vcapcd.org or faxed to 805-456-7797. The applicant should contact the VCAPCD directly if any of the listed equipment will be used. In those cases, we ask the applicant for more detailed information. If we determine the business is exempt from permitting, we stamp the bottom left corner of the questionnaire and return it to the applicant and/or appropriate agency. In most cases, our review of the questionnaire can be completed within one working day.

Note: Residential construction projects and residential charbroilers are exempt from VCAPCD permitting requirements.

A separate notification form may be required prior to any asbestos removal. For asbestos purposes, demolition is defined as the wrecking or taking out of any load-supporting structural member of a facility. In the case of a single-family residence where the owner-occupant is doing the work, the demolition or renovation is exempt from VCAPCD regulations.

Businesses that need to comply with VCAPCD's Transportation Outreach Program because they have more than 100 employees reporting to a worksite can do so by registering annually and completing a survey every two years.
